Australian Age Restriction & Account Policy

Australia Age Requirement: In compliance with Australian online safety laws, users under the age of 16 in Australia are NOT permitted to create or maintain accounts on any EARF service (earf.tv, METAR | EARF, EMERGENCY | EARF, EARFguess, Help & Support (help.earf.tv), About (about.earf.tv), or any related service). This applies regardless of parental consent.

  • Account Prohibition: Account creation by users under 16 in Australia is strictly prohibited. Users must represent and warrant they are at least 16 years old if accessing from Australia.
  • Automatic Account Removal: If EARF identifies that an account holder is under 16 years of age and is located in Australia, we will immediately and permanently terminate that account without notice, explanation, or liability to the account holder.
  • Data Deletion: Upon account termination due to age violation, all associated personal data will be deleted in accordance with applicable law.
  • Enforcement & Legal Action: Attempts to circumvent this age restriction through false information, proxy usage, or other means will result in account termination and may result in legal action.

Protection of Intellectual Property

All proprietary content, design, layout, graphics, and code created by or for EARF, including earf.tv, METAR | EARF, EMERGENCY | EARF, EARFguess, Help & Support (help.earf.tv), and About (about.earf.tv) are protected by intellectual property laws and are the exclusive property of EARF. This protection applies to all elements of the websites and services not covered by third-party rights, such as external videos or radio streams.

Any unauthorized reproduction, copying, modification, distribution, or exploitation of the intellectual property owned by EARF, whether found on earf.tv, METAR | EARF, EMERGENCY | EARF, EARFguess, Help & Support (help.earf.tv), About (about.earf.tv) or any of their Domains or subdomains, is expressly prohibited. Violators will face swift legal action. This includes, but is not limited to, the unauthorized use of EARF's website designs, code, logos, graphics, and other proprietary materials.

EARF reserves the right to pursue all available legal remedies against individuals or entities that infringe on its intellectual property rights. This includes immediate legal proceedings for injunctions, claims for damages, and the pursuit of civil or criminal penalties where applicable. Any individual or entity found in violation may be liable for significant monetary damages, including legal fees, and may face additional penalties under intellectual property law.

Platform Security, IP Checks, and Storage

To protect the security and integrity of our platform, EARF employs multiple automated and manual measures, including but not limited to:

  • IP, User Agent, and Device Fingerprint Screening: Every visitor's public IP address, user agent, and device fingerprint are automatically checked against our internal ban and abuse database upon arrival. This is to prevent access by previously banned or malicious users and to enforce platform rules.
  • Data Storage: These identifiers are not stored unless they match a banned or flagged entry, or trigger a security rule. If flagged, the IP, user agent, device fingerprint, and relevant technical data (such as timestamp) are logged for enforcement and security review. This information is retained only as long as necessary for security, compliance, and enforcement purposes.
  • Local Storage and Session Storage: We may store non-personal, technical, or preference-related data in your browser's localStorage and sessionStorage. This includes, but is not limited to, your theme choice, last viewed stream, compliance popup status, temporary tokens for session continuity, and security-related flags (e.g. FAFO triggers or temporary ban status). This data is only accessible by your browser and our site scripts, and is not used for advertising or profiling.
  • Third-Party Storage: Third-party services integrated into earf.tv (such as Google Analytics, YouTube embeds, or Google AdSense) may also use cookies, localStorage, or sessionStorage to store their own data on your device. Google AdSense is loaded only after you have granted advertising-cookie consent via EARF's consent popup. All third parties manage their own storage and data according to their respective privacy policies. Please note that the use of ad-blocking software or mechanisms that prevent EARF's advertising from rendering is a breach of EARF's Terms of Service.

By using this website, you acknowledge and consent to these security and storage practices. If you block or clear localStorage, sessionStorage, or cookies, some features of the site may not function as intended, or may function better if things are not working correctly, especially after a platform update.

These measures are in place to protect users, enforce bans, prevent abuse, and ensure the integrity of EARF's intellectual property and services. They are not used for profiling, marketing, or tracking legitimate users.

To protect the security and integrity of our platform, EARF employs an automated monitoring system known as FAFO. FAFO detects suspicious or unauthorized activity, including but not limited to the use of browser developer tools, attempts to tamper with site code, or behaviors indicative of abuse or circumvention of protections. If such activity is detected, FAFO may restrict your access, log technical data, and, in the case of repeated or severe violations, result in a temporary or permanent ban. Every FAFO trigger is logged and may alert the EARF Security Department. By using this website, you acknowledge and consent to this monitoring and agree that EARF is not responsible for any restrictions or consequences resulting from your actions. If you are banned, you will be shown an "Access Denied" page. Any attempts to bypass or circumvent a ban will trigger additional alerts and may result in further legal or criminal investigation and enforcement.

EARF’s intellectual property rights will be enforced to their fullest extent, and any infringement will be prosecuted in the appropriate legal jurisdiction. We take all violations seriously and will take necessary legal measures to protect our rights.

Any individual or entity found to be copying, imitating, or altering the content or structure of our websites without explicit written permission will be issued a formal notice and given7 days to comply and remove the infringing content. EARF disclaims all liability for any loss or harm arising from reliance on any output of its AI systems.

The names GAIA by EARF™, EOS by EARF™, ATHENA by EARF™, and ATLAS by EARF™, together with all associated branding, system architectures, model logic, and interfaces, are the exclusive intellectual property of EARF. YouTube Embed Licensing & Third-Party Content Rights

EARF displays embedded content from YouTube and other third-party platforms. By allowing embeds on their platforms, content providers (including YouTube) grant EARF and other websites the right to embed and display their content under their respective Terms of Service and API agreements. Specifically:

  • YouTube Embed License: YouTube's Terms of Service explicitly permit the embedding of public videos on third-party websites. By making a video public and allowing embedding, the content provider grants YouTube and any website using YouTube's embed feature a non-exclusive license to display that content. This license grants EARF the right to embed the video on our platform for viewing purposes.
  • Content Provider Authorization: If third-party content is embedded on EARF (whether from YouTube or other platforms), the content provider has authorized embedding through their platform's settings and policies. EARF respects these platform policies and only displays content that is publicly available and permitted to be embedded.
  • Limited License to Display: By embedding third-party content, EARF operates under the license granted by the content hosting platform. EARF does not claim ownership of embedded content but is permitted to display it in accordance with the terms of service of the content provider and the platform hosting the content.
  • No Implicit Endorsement or Licensing: The embedding of third-party content does not imply that EARF endorses the content, nor does it grant any additional rights beyond what is explicitly permitted by the content provider and their hosting platform.
  • METAR | EARF & EMERGENCY | EARF Data: Data displayed through METAR | EARF (meteorological data) and EMERGENCY | EARF (emergency information) services is sourced from public databases and government services. These services operate under the Fair Use doctrine and applicable public domain regulations. All METAR data is public domain information maintained by aviation authorities. Emergency information is displayed in accordance with public information distribution laws.

If a content provider wishes to revoke embedding permissions or believes that EARF is misusing embedded content, they may contact us at [email protected] with evidence of the infringement or policy violation, and we will take appropriate action in accordance with applicable law.
